Andhra Pradesh High Court Dismisses Plea Against Minimum Age Condition In NEET

New Delhi: The Andhra Pradesh High Court division bench of Chief Justice Prashant Kumar Mishra and Justice R. Raghunandan Rao dismissed a petition challenging the constitutional validity of the fixation of a minimum age of 17 years for appearing in the National Eligibility-cum-Entrance Test (NEET).

 

The bench stated that the constitutionality of the 17-year as the minimum age requirement for NEET had already been decided by the High Court.

 

The writ petition challenged the constitutionality of Regulation 4(1) of the Medical Council of India Regulations, which establishes a minimum age of 17 years as an eligibility criterion for appearing in the NEET exam.

 

The Petitioner claimed that fixing a minimum age of 17 years for the NEET exam violates Articles 14, 19, and 21 of the Indian Constitution. As a result, the aforementioned Regulation should be repealed.

 

The petition was dismissed by the High Court because the issue had already been considered numerous times. To begin, in the case of Master Alli Sai Deepak v. The Government of Andhra Pradesh Rep., by its Principal Secretary, Higher Education Department, and others, Kandula Yamini Saraswathi v. Union of India Rep., it was represented by its Secretary, the Government of India, the Medical and Health Department, New Delhi, and others.

 

The court observed  “In Master Alli Sai Deepak's case, it was held by a Division Bench that, the fixation of a minimum age of 17 years as eligibility criteria to participate in the subject examination does not offend the equality clause of Article 14 of the Constitution of India. The said judgment has been followed by another Division Bench subsequently in the matter of Kandula Yamin Saraswathi case”.

 

In light of the preceding cases, the writ petition was dismissed.
