Andhra Pradesh HC passes directions to state authorities in a suo moto case of the Vizag Gas leak

Andhra Pradesh HC Passes Slew of Orders to State Authorities in a suo moto Case. Andhra Pradesh's High Court has taken suo moto recognition of the leakage of 'Styrene' gas in Vizag, involving a number of casualties.

The Court acknowledged that in compliance with the provisions of the Environmental Protection Act 1986 and the 1996 Chemical Accident (Emergency Planning, Preparedness and Response) Regulations, ‘Styrene’ is identified as a hazardous material and certain crisis management measures need to be taken, such as formulating the Crisis Warning System, the Central Crisis Group, the State Crisis Group all the further down to the local crisis group.

A bench comprised of Chief Justice Jitendra Kumar Maheshwari and Justice Lalitha Kanneganthi ordered the government to take "immediate measures" to minimize the impact of gas leakage by sprinkling water or other substances that could minimize further harm by seeking the deployment of fire services from nearby areas. Further, the bench also directed that repeated gas leakages should be tested at the same time.

The State Government was ordered to appoint a committee of officers not below the rank of Principal Secretaries to monitor the activities and to file compliance reports within one week.

The Chief Secretary is expected to oversee all of the disaster management authority's operation. The State Legal Services Authority has been directed to appoint a suitable officer from the District Legal Services Authority, Visakhapatnam to monitor the activities, and the District Judge, Visakhapatnam can coordinate on the matter with state officials. In this case the Court has named senior lawyer YV Ravi Prasad as Amicus Curiae.

Earlier, during the week hours of Thursday, the National Human Rights Commission and the National Green Tribunal had taken notice of the tragedy caused by the leakage of Styrene gas from 'M/s LG Polymer Industries Pvt Ltd' at RR Venkatapuram in Vizag district.
