Amendments to HIV and AIDS (Prevention and Control) Bill, 2014

On 11th April 2017 the parliament passed the historic Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) (Prevention and Control) Bill. The bill was passed in Rajya Sabha on 21st March, 2017 and prohibits discrimination against people living with HIV (PLHIVs) on grounds of treatment, employment and workplace. It provides for complete confidentiality, helps in safeguarding patients’ rights, and also creates a proper grievance addressing mechanism.

The Bill lists various grounds on which discrimination against HIV positive persons and those living with them is
prohibited. These include the denial, termination, discontinuation or unfair treatment with regard to:
(i) employment,
(ii) educational establishments,
(iii) health care services,
(iv) residing or renting property,
(v) standing for public or private office, and
(vi) provision of insurance (unless based on actuarial studies). The requirement for HIV testing as a prerequisite
for obtaining employment or accessing health care or education is also prohibited.
