Aircel Maxis Case: Delhi HC issues Notice to P Chidambaram & Karti Chidambaram on ED's Plea for cancellation of Anticipatory Bail

A Single-Judge bench comprising of Justice Suresh Kumar Kait has issued notice today to Former Union Minister P Chidambaram and his son Karti Chidambaram in the revision petition filed by the Enforcement Directorate (ED) to cancel their anticipatory bail granted by a Special CBI court in the Aircel Maxis case.


On September 5, the Court of Sh. O.P. Saini, Spl. Judge, CBI had granted pre-arrest bail to both P Chidambaram and Karti Chidambaram in the Aircel Maxis case while observing that there was no possibility of flight risk or tampering with evidence as both the accused persons were public figures and had deep roots in society.


The Ld. ASJ had further observed that the amount alleged to be laundered by both, the accused persons were paltry as compared to the other co-accused persons who were already granted bail by the court. The Court had allowed the anticipatory bail applications of both the Chidambaram while ruling that an investigating agency should not discriminate against two similarly placed accused, as it is against the law.


Being aggrieved by the aforesaid order, the ED filed the present plea for cancellation of their anticipatory bail. The ED was represented by Solicitor General Tushar Mehta, who argued on their behalf that the Special Judge had erroneously based and placed reliance on the Supreme Court’s decision in the INX Media case against the father-son duo as the INX Media case was similar in nature.


The Aircel Maxis case also pertains to the alleged irregularities in the FIPB clearances granted by P Chidambaram who was the Union Finance Minister at that time. It is alleged that at that time, Karti Chidambaram had received kickbacks for ensuring that FIPB clearance for Rs. 3,500 Crore deal between Aircel & Maxis was granted as his father was the union finance minister and the money received was laundered through various shell companies registered by Karti Chidambaram abroad.


The CBI and ED, both have registered separate cases under the Prevention of Corruption Act and Prevention of Money Laundering act the Chidambaram and charge-sheet in both the matters was filed in 2018.


The present matter seeking cancellation of anticipatory bail of both P Chidambaram and Karti Chidambaram in Aircel-Maxis case would now be heard on November 29.
