Aggressive Behaviour Of Wife Not A Ground For Divorce Holds Punjab & Haryana High Court

Mere an aggressive behaviour and sadness of mood of wife doesn't mean that the wife is spoiling the atmosphere of her matrimonial home, stated the of Punjab and Haryana High Court while dismissing a matrimonial appeal filed by a husband.  

In his petition before the Family Court, the husband alleged that his wife is possessed with independent and modern thoughts pretending herself to be a broad minded lady. He contended that she was always busy on Whatsapp and Facebook with strangers and friends and She refused to do household work. He also alleged that his wife had illicit relationships. The wife denied all these allegations.

The bench further "To our mind, in the present case there is ordinary wear and tear of the married life of the parties, which happens in day to day life. Mere aggressive behaviour and sadness of mood of wife does not mean that the wife is spoiling the atmosphere of her matrimonial home."

The bench while confirming with the Family Court's order stated that the husband has failed to produce any cogent evidence against the wife. Nuptial knots cannot be allowed to be broken on such types of unfounded allegations of cruelty, be it physical or mental.
