A TRANSGENDER WOMAN HAS THE STATUS OF A 'BRIDE' UNDER HINDU MARRIAGE ACT, 1955: Madras High Court

The marriage Registrar in Tamil Nadu had refused to register the marriage of the newlywed couple. The wedding ceremonies took place between a man and a trans woman. The couple got married in a temple and sought formal recognition of their marriage, registration with the legal authorities. But they were denied being registered as husband and wife in the eyes of law. They then approached the Madras High Court.

The Madras High Court bench observed that 'not registering their marriage' on the ground that the trans woman cannot be given a status of woman is completely wrong on the part of Authorities and held that the term 'bride' under Hindu Marriage Act (HMA) also includes a trans woman. Thus, it is not confined to only 'a person born as woman'.

The Madras High Court has set a precedent and this will help the transgender people to live their lives without any discrimination, thus strengthening their human rights. Also, their right to get the marriage registered is now strengthened by this verdict of High Court.
