A Murder Is A Murder Even If Arising Out Of Matrimonial Dispute Affirms Supreme Court while Denying Bail To Murder Convict

A murder is a murder either arising out of matrimonial dispute or otherwise, confirms Supreme Court while rejecting the bail application of a man who is in custody nearly from 13 years.

Pankaj was convicted in a murder case, and he is in custody since 22nd March, 2006. His appeal challenging the order of conviction is pending before the Allahabad High Court from 2009. Four of his bail pleas were rejected by the High Court.

Before the Supreme Court, it was contended that the offence was related to matrimonial dispute, after hearing the contention, the bench comprising Justice Indira Banerjee and Justice Sanjiv Khanna said:

"Maybe offence is related to matrimonial dispute as contended by the petitioner but that is inconsequential. A murder is a murder whether it arises out of matrimonial dispute or otherwise."

Wherein, taking note of long pendency of the appeal, the bench directed the High Court to hear and dispose off the appeal within 3 months. In the event, the appeal cannot be disposed off within 3 months, the High Court shall grant bail to the petitioner on such terms and conditions as it deems appropriate, Supreme Court stated.
