22 Years After Acquittal Of Accused In Murder Case, Bombay Sets Aside Order, Sentences Accused To Life [Read Order]

Overturning an order of the Additional Sessions Judge, Kolhapur who acquitted the accused in a murder case, the Bombay High Court has held the accused guilty and given him three months’ time to surrender.

The bench of Justices AS Oka and SS Jadhav found the accused, Krishnath Baburao Patil guilty of offence punishable under Section 302 of IPC and sentenced him to life.

Court however did not record the reasons in this order and stated that the reasons will be recorded separately.

The period of detention pending trial and pending appeal was set off under section 428 of the Code of Criminal Procedure by the Court.

Thus, the criminal appeal filed by the State of Maharashtra against the order of acquittal by the trial court in Kolhapur was allowed.
