1989 Bhagalpur Riots: Supreme Court will hear petition against acquittal of accused

The Supreme Court of India has agreed to hear an appeal of the Bihar Government against the acquittal of Kameshwar Prasad Yadav in the 1989 Bhagalpur communal riots, in which over 1,000 people lost their lives.

Yadav was given clean chit by the Patna High Court in June this year in a case related to the killing of muslim teenager. The high court had set aside the life-term awarded to him by a trial court in the murder case.

The Nitish Kumar-led government had decided to reopen the riots cases in 2006. After this, a court in Bhagalpur blamed Yadav (58) in this case on November 6, 2009.  Justice The bench of Justice A.K. Sikri and Justice Ashok Bhushan accepted the appeal of the state government and directed to hear the matter promptly.

Senior Advocate from the State Government K. T. S. Tulsi and advocate Shoeb Alam said that the High Court incorrectly canceled the order of conviction on the basis of delay in lodging the FIR. The senior advocate said that it is an established law that delay in the FIR in cases related to communal riots will be seen in the light of the fact that there was turmoil in the city and people were upset and afraid of coming forward for testimony against the conspirators.

Yadav was arrested for the first time in 2007. He has been acquitted of 3 different cases of riots and after the verdict in this case by the High Court, he came out of jail in July.

He was booked in the case by Bhagalpur Police in 1990, over three months after the murder, on a complaint lodged by Qayamuddins father. The Nitish Kumar government in 2005 had decided to reopen 27 Bhagalpur riots cases in which over 1,000 people were killed in the violence that had started on October 24, 1989, in over a dozen villages there.
