'We trust Chief Justice of Delhi HC will take a proper decision', SC disposes of pleas challenging resumption of Physical Hearings

On Wednesday, 20th January 2021, the Supreme Court was hearing a plea which challenged the order of the Delhi High Court regarding the physical hearing of the Courts. On 14th January, 2021, Delhi High Court had directed all the lower Courts to begin physical hearing on an alternate day basis.

Few lawyers had objected the decision of the High Court and filed an appeal to the Supreme Court and had stated that, the direction of the Delhi High Court clearly violates the fundamental right and also the particular direction of the Court leads to violation of health hazard.

The petitioners had informed the Supreme Court about a meeting which will be conducted with the Registrar General of the Delhi High Court. After listening to this, the Court had directed the petitioners to get back to the Delhi High Court as this Court would dispose of this particular matter.

Senior Advocate Geeta Luthra requested the Court to hear this matter at the next date, but in reply, CJI Bobde had stated that, Supreme Court has full faith in the Chief Justice of Delhi High Court and the top Court is also sure that the Delhi High Court will take a proper decision.

The Court had also stated that resumption of physical hearing is mandatory but not without any medical opinion on board. The Court is also aware of the problems of the Bar regarding this matter.
