“Should we postpone Dussehra vacation?” CJI Gogoi rebukes Bar for indiscriminate mentioning of matters

Chief Justice of India (CJI) Ranjan Gogoi once again expressed strong discontent with Bar's persistent mentioning of matters which did not involve extreme urgency.

When the SC Bench headed by CJI Gogoi sat at 10.30 am today, a lawyer mentioned before the bench a matter which had been deleted from the list.

At this point, Chief Justice Gogoi told the lawyer that he will look into the matter and make sure that it is listed after the Dussehra vacation.

The lawyer, however, persisted for an early listing of the case.

At this point, the CJI asked the lawyer, “Which part of what we said don’t you understand. Should I take consent of all lawyers and postpone the Dusherra vacation.”

Subsequently, when another matter relating to BCCI was mentioned with the lawyer again seeking an urgent hearing tomorrow, CJI Gogoi did not mince his words and said:

Regardless of our views on Cricket, what will happen if it is listed after Dussehra? Heavens will fall? Please go away.”

The CJI also expressed his dissatisfaction – when several additional cases were mentioned before the bench – by saying:

We told you we are evolving guidelines, yet the Bar keeps mentioning matters. You are mentioning cases for quashing FIRs etc. At this rate, the Bar will lose the privilege of mentioning.”

But the Bench did agree to hear a plea challenging the West Bengal Government’s decision to grant a sum of Rs 10,000 to Durga Puja committees in the state, after it was mentioned this morning. CJI Gogoi said, the court will hear this matter tomorrow.

CJI Gogoi, since his first day as country’s top jurist, has been clear on his strategy regarding mentioning of matters when he stated that urgent mentioning of matters would not be allowed in the court, until parameters for the practice are worked out.
