#MeToo: SC refuses to hear petitions seeking registration of FIRs against accused persons

A Supreme Court bench headed by CJI Gogoi on Monday dismissed two petitions seeking the top court to provide direction to the police to register FIRs against those accused of sexual misconduct and assault leveled by women during the #MeToo movement.

The two separate PILs were filed by advocate Manohar Lal Sharma and Mahesh Kumar Tiwari on the issue of sexual misconduct and assault reported by the #MeToo victims.

Advocate Sharma, in his petition, had sought the Supreme Court to take suo motu action against all the accused named by the #MeToo victims.

Sharma in his petition also wanted the top court to direct the investigators to record statements of the #MeToo victim ladies as information within the provision of Section 15 of Cr.P.C. to initiate registration of Criminal cases or FIR under Section 354/357/376 and other of IPC.

The advocate also demanded constitution of fast track trial courts to deal with cases against a #MeToo accused in a time bound manner, as in several instances of #MeToo, high profile people are involved – because of which a lot of matters are not even going to trial.

At this point, the CJI commented:

In any case, why should Manohar Lal Sharma come?

The CJI-headed bench then refused to entertain the petitions.

Heard the petitioner appearing in-person and perused the relevant material. The issues highlighted would be considered by the court in the event an aggrieved person moves the court. The writ petition is, therefore, not entertained on the aforesaid ground. The same is, accordingly, dismissed,” the court noted in its order.
