THE ARMED FORCES TRIBUNAL ACT, 2007

On the 8th August 2009, the President of India inaugurated the Armed Forces Tribunal.

The Armed Forces Tribunal Act 2007 was passed by Parliament and led to the formation of AFT with the authority of the Armed Forces Tribunal to adjudicate or prosecute disputes and allegations relating to promotions, appointments, certificates and conditions of service relating to individuals subject to the Armed Forces Act 1950, the Navy Act 1957 and the Air Force Act 1950.

AFT has Local Benches in Chandigarh, Lucknow, Kolkatta, Guwahati, Chennai, Kochi, Mumbai, Jaipur in addition to the Chief Bench in New Delhi.

What is Court Martial?

The military personnel have different laws, rules and regulations to enforce penalties on the wrongdoer for which they have different trials and procedures. The military court case is known as a court martial. We have different courts, different rules and different representatives to conduct martial courts other than the regular Indian courts. Court-martial is a military personnel court system for breaking the military rules or committing other military offences. Their are majorly 4 types of court martials i.e general court martial, district court martial, Summary general court martial, Summary court martial.

Appeal against order by Court Martial to Tribunal

According to section 15(2) of The Armed Forces Tribunal Act,2007 every person liable for penalty by a court-martial order, verdict, judgment or punishment may prefer an appeal in the form, manner and time specified.

Section 15(4) of the act an appeal can be dismissed if the trail of court martial is resulting in miscarriage of justice

Limitation to Appeal in a Tribunal

As per the Section 22 of the Armed Forces Tribunal Act,2007 ,the Tribunal will not accept a submission of an Appeal unless the appeal was lodged within six months of the date on which the final order was issued.
