DECRIMINALISATION OF OFFENCES U/S. 377 I.P.C.

DECRIMINALISATION OF OFFENCES U/S. 377 I.P.C.

The Supreme Court has finally upheld the plight of gay, transgenders and homosexual sections of the society after a long fought legal battle. At this stage, it is futile to debate on the moral, ethical and social aspects of this issue. Now it is pertinent that these sections must be granted equal status in the society, both legal and social. At present, there are many privileges that are left to be afforded to these sections as the other people enjoy. Further, only legislation is not sufficient enough to achieve this end. It is for the society as a whole that the mindset has to be changed so that they are offered equal status by the others. It must be noted that any act of privacy by an individual does not affect the fundamental rights of the others. So, such persons must be included in the mainstream without any stigma. It is worth consideration that a valuable stock of hidden talent is likely to surface which will be for the welfare of the society as a whole.
