Another dead end for Kit-Kat in Europe!

Four wafer sticks covered in chocolate that is exactly what Kit-Kat is but do you know that Kit-Kat has been shedding blood, sweat and  tears to get this “four wafer sticks covered in chocolate” design trademarked for more than a decade now but Chocolate Giant Mondelez (which wholly owns Cadbury) has left no stones unturned to prove against Kit-Kat’s claim.

Though the design is already protected in Australia, Canada and South Africa but getting the same in Europe and the UK has been a pain in the neck for Kit-Kat. The European Court of Justice gave a judgment on 25/07/2018 dismissing Nestlé’s plea, putting a question mark to their design protection in European markets, which could lead to brand imitations in the local markets.

Not only imitations but this judgment will allow Mondelez, to market and sell their similar wafer covered chocolate bar “Kvikk Lunsj” more widely throughout 28 countries in Europe. With this judgment, the battle of hearings and frittering time & money might come to an end!
