Supreme Court issues notice in petition filed challenging Karnataka High Court’s order refusing to quash rape case filed by wife against her husband & holding that exception of MaritalRape to husbands is not absolute.

Sr Adv Indira Jaising appears for respondent wife on caveat

CJI: Take notice we’ve to hear the matter.

Jaising: There’s been a stay on proceedings for 5 years. Judgment has just been delivered Wife has been waiting indefinitely for trial to proceed

Bench- Give date in third week of July

Jaising: charges have been framed

Sr Adv Siddharth Dave appears for petitioner: on charge..

CJI: We’ve given a date, you go request the HC.

Dave: can there be notice on stay as well

Bench: we’ll hear the matter what’s the problem

Dave: 29th the trial will start.

Bench: Tell them we’re seized of the matter
