Bombay High Court dismissed a PIL filed against the Avinash Bhosale Group

The Bombay High Court dismissed a Public Interest Litigation (PIL) on 24th July 2019 with the following details. The PIL was filed by petitioners Rajesh Khairatilal Bajaj, Rajesh Alias Bobby Bajaj, and others against Avinash Bhosale Group and others. The Hon'ble Chief Justice of Bombay High Court dismissed this motion observing that some individuals abuse laws like PIL and use it to extract money from other parties. The Honourable Court has also mentioned that the individuals who profess to support public causes must be of the highest moral character.


Rajesh Bajaj, residents of Bhosale Nagar, and others filed a PIL in 2015 against Avinash Bhosale Group's residential project, Castel Royale Towers.


The case was dismissed initially in 2016 because of the petitioner's defaults. During the last hearing on the subject before the Noble Court, one of the petitioners attempted to justify defaults by citing viral sickness and continuous medical treatment. However, the Honorable Court was informed that in the earlier periods when default occurred, the petitioner was amidst prosecuting a Criminal Complaint, according to the situations on record. A dubious medical certificate was also filed by the petitioner. Rajesh Bajaj, another petitioner, was discovered to be impersonating a lawyer, contrary to the facts, as the Honorable Court had already recognised.


"We have been continuously defamed by self-proclaimed RTI activists, but we have maintained our faith in the judiciary, and the truth has now prevailed. We are certain that such orders will serve as a deterrent to fraudulent lawsuits. The RTI Act, as well as other mechanisms like the Public Interest Litigation Act, are frequently abused for self-serving ends, and this must stop." said in response to the verdict, Mr. Amit Bhosale, Managing Director of the Avinash Bhosale Group.
