The State of Rajasthan filed a Counter Affidavit in the plea filed by Asaram Bapu, opposing his bail plea stating that the petition of the life convict seeking temporary suspension of sentencing to pursue medical treatment and changing his place of his custody had ulterior motive. 

The Counter Affidavit was filed challenging Rajasthan High Court’s order, wherein Asharam Bapu’s plea seeking temporary suspension of sentences to pursue was dismissed.

The State averred that this is the third time that the Petitioner has prayed to get his sentence suspended, after two of his earlier pleas seeking to be treated at Ayurvedic and allopathic Centers had been dismissed.

The Stats’s Counter Affidavit places its reliance on a medical report issued by AIIMS Jodhpur highlighting the patient’s uncooperative nature, refusing to take medicine and injections.

The Bench comprising Justices Navin Sinha and Ajay Rastogi informed the Counsels present that they had sent instant reply on behalf of the State of Rajasthan on the morning of June 8th, 2021, and adjourned the matter to Friday.

Supreme Court, during the last hearing on the matter headed by Justice BR Gavai issued a notice and agreed to evaluate if the Petitioner can be temporarily shifted to an ayurvedic centre after Senior Advocate Siddharth Luthra has argued that the medical condition of the petitioner was dire and required immediate medical treatment.
