An Adult Woman Is Allowed To Live Independently Whenever She Wishes Or With Whom She Wishes To Live: Delhi High Court

The High Court of Delhi in its order dated November 24, 2020, has allowed an adult woman to live freely whenever she wishes or with whom she wishes to live.

A writ petition of habeas corpus was filed before The High Court of Delhi under Article 226 of The Indian Constitution in Ms. Parveen vs. The State NCT of Delhi & Ors.[i], seeking to produce Sulekha (sister of petitioner) before the Court who went missing on 12.09.2020. The court directed the authorities to track Sulekha. She has been traced and produced before the Court. While hearing through video conferencing the Court finds that she has been moved with Babloo and married him. The same was recorded under Section 164 of The Code of Criminal Procedure, 1973. The bench comprising of Justice Vipin Sanghi and Justice Rajnish Bhatnagar has permitted Sulekha to reside with Babloo and directs police authorities to protect her and safely get her to the residence of Babloo and also directs that mobile phone number of the constable of the police station where they both resides should be provided to both, so that they may get in touch with police officials in case of need. The Court also directs the police authorities to counsel the family of Sulekha not to take the law into their hands. Hence, the petition stands disposed of in the aforesaid terms.
