Appeal To Government To Establish Marriage Counseling Centers To Ensure Harmony And Peace: Court of Jammu and Kashmir

In Raj Kumari vs. UT of J&K CNR. [1]A woman aged 32 years was made a constant victim of mental and physical cruelty by her mother-in-law, husband, and brother-in-law, which lead her to commit suicide. An FIR was filed against the offenders under Sections 304B, 498A, and 120B of The Indian Penal Code, 1860, on October 11, 2020 by deceased’s father.

An application for anticipatory bail was filed by the accused on November 10, 2020 which was rejected by the J&K Court stating that “Anticipatory bail is meant only for those bonafide persons who are unnecessarily roped in an offence on account of some vengeance and not for those who are explicitly involved in serious offences like dowry death and seek anticipatory bail”.

Court also appealed to the Government by adding that there must be an establishment of Marriage Counseling Centers in every District of the Union Territory, so that families of both partners can sit together and have parleys to ensure harmonious and peaceful settlement of matrimonial misunderstandings.
