By way of   the writ petition we have challenged the eligibility condition No.(vii)(viii) of the Notification of National Eligibility Entrance  Test(NEET),2018 which read as follows:-

(vii) Provided that the two years of regular and continuous  study of Physics, Chemistry , Biology/Bio-Technology  taken together shall be required  at 10+2  level for all the candidates.

(viii)  candidates who have passed 10+2  from Open  Schools  or as Private candidates shall not be eligible to appear for National Eligibility -cum- Entrance Test-UG . Furthermore, study of Biology/ Bio Technology  as an Additional Subject at 10+2 level also shall not be permissible.

The grievance in the aforesaid matter was regarding the eligibility criteria of private candidates who have taken biology  as an Additional subject in their 10+2 level and cleared their National Eligibility Entrance  Test (NEET), 2018  but unfortunately got barred  from the counselling under the amended notification dated 23.01.2018 issued by MCI, with a prayer that such students  must be allowed for counselling along with the rest of students that was allowed by the Single Bench of Hon'Ble High Court, Lucknow Bench , Lucknow
