Writ Of Habeas Corpus


The purpose of this form is served under Article 32 of the Indian Constitution which states writ petition. Writ petition can only be filed when fundamental rights have been infringed. The writ of habeas corpus means “unlawful detention” or "that you have the body" which infringes right to personal liberty under Article 21. Habeas corpus is a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person's release unless lawful grounds are shown for their detention. Under this writ of habeas corpus the Supreme Court of India holds the original criminal jurisdiction.
