Licence To Possess And Use Public Display Fireworks


Under Article 10 of Schedule IV of the Explosives Act, 1884, there is a procedural requirement to obtain license to Possess and Use Public Display Fireworks. The above license could be obtained by duly submitting the Form 29 as mentioned in Rule 155 of the said act. According to the procedure certain disclosures need to be made by Licensee to the Controller of Explosives while submitting the Form 29 (Licence to Possess and Use Public Display Fireworks) which are listed below:

a. Description of Premises which is being used for Public Display of fireworks with full address and duly attached plan specifying the area. 

b. Description of premises which is being used to store fireworks with full address.

c. Full Address of the licensee for further correspondence.

After which the Controller of Explosive grants the permission for the prescribed quantity of fireworks as duly mentioned in the license.

It also lays down some conditions which shall be adhered by the licensee after obtaining such license under Form 29, few of which are as following:

1. There shall be minimum seven clear days (excluding Sunday and public holidays) time in public display of fire works which is notified to licensing authority by licensee.

2. Details of the person from whom the fireworks have been or are to be obtained, shall be notified to the controller of explosives.

3. Details of all the persons who will be involved in public display of fireworks and there detailed experience of each individual mentioned in it.

 4. Adequate distance shall be adhered between the spectators and the area where it is to be displayed.

5. Proper care need to be ensured after fireworks are purchased and stored for public display in the area specified under the licence & shall not be left unattended.

6. Firefighting equipment shall be present to fight reasonably anticipated fire.

7. No firework shall be ignited inside of or closer than 15 meters of any tent, trailer, canvas shelter of motor vehicle.

8. Person involved in public display shall wear protective clothing, ear defenders, safety glasses and other protective.

9. Free access to the authorities for inspection at the licensed premise on a reasonable time for ascertaining the conditions of provisions of the act and Rules and conditions are duly observed.
