A deed of trust is a legal document among three parties: the borrower, the beneficiary and the trustee who holds the legal title to the property. These deeds have the full force of law and are virtually incontestable, making them highly authoritative documents regarding the use and disposition of a piece of property. Common reasons for modifications include changes to the description of the property or a change of beneficiaries. Once the modification has been filed, it replaces any conflicting information in the original deed of trust.

Sign the modification and have it notarized. Send the modification to the other parties if you cannot meet with them in person, and have them sign and notarize the document as well.

 

File the deed of trust modification in the county courthouse in the county where the property is located. There may be a filing fee for this service, which you can find by contacting your county clerk. This information also may be posted on the county's official website.

 

Request certified copies of the deed of trust modification and give them to the other parties to the deed of trust.

 

A deed of trust is a legal instrument used in the creation of a trust. If any one of the parties involved in a trust observes an omission or error in a deed of trust, he can request a modification be made to the deed of trust. All modifications are legally binding.
