On December 09, 2013, India enacted the bill on women safety at workplaces as the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“Act”) to address the issue of women safety outside their homes especially when they are interacting in workplaces.

 

This Act recognizes the lack of structured and confidential medium for accessing any justice for sexual harassment experience, or inability of a woman to not to report such incidents to authorities. Keeping this in context, the Act has introduced several new roles at State, District and Organization level to provide an accessible, confidential, timeline and process driven access to seek redressal in instances of sexual harassment experienced by women at workplaces.

 

One of the roles that has become extremely crucial and relevant for lawyers and legal professionals is the role of External Member on Internal Complaints Committees of organizations. Workplaces are currently actively seeking a professional advisory for not only completing the guideline requirement under this Act but also a professional to guide the Internal Committee on proper investigation and redressal procedures.
